As a member of the Uyghur community in US, I welcomed the news of U.S. District Court Judge Ricardo Urbina’s order requiring the U.S. government to release into the United States the 17 Uyghurs detainees currently held at Guantánamo Bay, Cuba. I was disappointed and concerned, however, to learn of the government’s decision to appeal the ruling.

Uyghurs have nothing against US no matter where they live in the world. In fact, all Uyghurs consider US as a friend. I expect those 17 Uyghurs in Guantanamo to be no exception. It is no suprise that they are not considered “enemy combatants” by the Department of Defense. I applaud the U.S. government’s decision not to return the Uyghurs to China, where they will face torture, humiliation, life imprisonment and perhaps death. I similarly commend the extensive diplomatic efforts the government has expended to find another country where the Uyghurs will be safe. Yet, the lack of success to date and the poor outlook for finding a receiving country means that the Uyghurs are effectively being detained indefinitely, in violation of the U.S. Constitution and international law.

Some reports surfaced today say US government talking to small countries where there is no Uyghur communities to settle those men. It would be an absolute catastrophe for them to end up in a country where they are not familiar with the local language or culture and could not find familiar faces to help them deal with the problems they encounter. Seven years' of harsh imprisonment perhaps has done significant psychological damage to them which needs to be repaired in a caring community of their own countrymen.

Washington, DC has a large Uyghur community that has committed to care for the released detainees, including by helping them adjust to life outside Guantánamo Bay. Religious groups and refugee settlement agencies have also offered their assistance. In the spirit of humanitarianism and justice, the U.S. government should withdraw its appeal to Judge Urbina’s ruling and allow the Uyghur detainees to be released onto this welcoming community. Having determined that these men do not need to be detained, the U.S. government is now obliged to work for fair, safe, and durable outcomes for them. This can best be done by withdrawing the appeal and permitting the Uyghurs from Guantánamo to reside in the United States.
